GENIUS Act: where the states stand

The GENIUS Act lets a state supervise payment stablecoin issuers with up to $10 billion in issued stablecoins, but only if its regime is certified as substantially similar to the federal one. A payment stablecoin is a digital token that the issuer must redeem for a fixed amount of money, such as one US dollar.

  • The GENIUS Act became law on 18 July 2025. Treasury expects it to take effect on 18 January 2027, 18 months after enactment. (Treasury interim final rule)
  • A state that wants its own regime for payment stablecoin issuers must certify to the Stablecoin Certification Review Committee (Treasury, the Federal Reserve and the FDIC) that the regime is substantially similar to the federal one. The first certification is due within one year of the effective date, which Treasury puts at 18 January 2028. (Treasury interim final rule)
  • Treasury says a certification filed by 18 January 2028 meets the deadline even if it is conditional on further state law or rules, or otherwise incomplete. (Treasury interim final rule)
  • Treasury will not accept certifications until the form receives Paperwork Reduction Act approval, and will post a notice on its website when filing opens. Comments on the procedures close on 30 November 2026. (Treasury interim final rule)
  • The Act asks the committee to aim for faster review for states that had a regime for digital assets or payment stablecoins in effect by 14 January 2026. (Treasury interim final rule)
  • Treasury published the principles it proposes to use to judge "substantially similar" on 3 April 2026. Comments closed on 2 June 2026. The principles are not yet final. (Treasury proposed principles)

How we track this

  • MTMA status follows the CSBS adoption map and its state enactments table dated 8 October 2026. CSBS states that 31 states have enacted the model law. Its map shows those 31 as enacted and four more (California, Connecticut, Rhode Island and Utah) as enacted in part. Our counts match.
  • Bill references come from the CSBS legislative update (August 2026). Enactment dates come from the state legislature's own record, read for each state where we could open it. Effective dates come from the two CSBS documents, checked against the legislature where we could. Where the two CSBS documents disagree and the state record did not settle it, we show the status without a date.
  • A state counts as having a stablecoin regime when a law or regulator framework in that state licenses or charters payment stablecoin issuers. We read each statute or regulator notice. Proposals are described but not counted.
  • GENIUS Act certification status comes from Treasury's interim final rule of 30 September 2026 and the Federal Register. Treasury will post a notice when it begins accepting certifications. As at the date of this page, it has not.
  • Each state's licensing link goes to its page on the NMLS State Resource Center, the system state regulators use for money transmitter licences.
  • We link only to primary sources: CSBS, state legislatures, state regulators, Treasury and the Federal Register.

Main sources

What we could not confirm

  • Enactment dates we could not confirm on a state record: Arizona, California, Connecticut, Georgia, Hawaii, Illinois, Indiana, Kansas, Mississippi, Missouri, Nevada, New Hampshire, Rhode Island, South Carolina, South Dakota, Virginia, West Virginia and Wisconsin. Maryland adopted the model law by regulation.
  • Effective dates where CSBS documents disagree and we show none: California, New Hampshire, North Dakota and South Carolina.
  • Indiana's 2026 bill to prohibit virtual currency kiosks (H.B. 1116) passed the General Assembly, but we could not confirm the Governor's action on an official page, so it is not listed.
  • No state regulator or Treasury has published a GENIUS Act certification. Treasury has not said whether it will publish the certifications it receives.

Questions

The Money Transmission Modernization Act (MTMA) is a model law written by state regulators through the Conference of State Bank Supervisors (CSBS). It gives states one set of rules for money transmitters on capital (net worth), surety bonds and the assets a firm must hold against customer money. Each state adopts it by passing its own law. CSBS states that 31 states have enacted it, and its map shows four more that have adopted parts of it.

Four states enacted the model law in 2026: Louisiana (in force 1 July 2026), Oklahoma (in force 1 November 2026), Delaware (signed 6 July 2026, applying by 6 July 2027 at the latest) and Alaska (in force 1 July 2027). Bills are pending in Michigan.

A state must file its first certification within one year of the GENIUS Act taking effect. Treasury expects the Act to take effect on 18 January 2027, so the deadline is 18 January 2028. Treasury has said a certification filed by then counts even if it is conditional or incomplete. Filing opens once Treasury posts a notice on its website.

No. As at 30 October 2026 Treasury has not opened filing, so no state has filed. Florida and Delaware have passed laws that direct their regulators to file, and New York has proposed a regulation designed to meet Treasury's proposed test.

No. A money transmitter still needs a licence from each state where it serves customers, applied for through NMLS. The MTMA brings the rules closer together, which makes multistate applications and examinations simpler. Montana is the one state that does not license money transmitters.

Licensing in more than one state

Most firms that move money in the United States need a licence in each state where they serve customers, alongside federal registration as a money services business. The requirements, bonds and timelines are on our US money transmitter licence, FinCEN MSB registration and US payment stablecoin issuer pages.

For the federal route for stablecoin issuers, read how to apply as a GENIUS Act stablecoin issuer. For what a licensed money transmitter must do each year, see money transmitter compliance requirements and our money services businesses hub.
